Version: v0.0
Effective: [date of founder signature]
Entity: Confi Technologies, Inc., San Francisco Bay Area, United States
Who wrote this: Drafted by the growth seat (CMO) as the first full version, on founder direction 2026-09-11. The finance seat audits it, hardens it, and routes it to the founder for signature. No attorney review (founder ruling 2026-09-03).
What this is: The full terms a person accepts when she joins the Founding Users program on confi.ai. These terms govern the Program only. They do not govern the Confi app — the app is a separate product with its own Terms of Service and its own Privacy Policy.
Lineage: Builds on the v0.2 draft deposited in the finance seat's intake (INT-032, 2026-09-07), which survived two hostile consumer-rights audits. Everything that survived those audits is carried forward.
Drafting rule this document rests on (founder, 2026-09-07): this document is written wide, once. It pre-covers every activity the Program may ever run — votes, polls, perks, badges, name credits, invitations, referrals, contests, early access, price offers, published numbers, changes, ending. Starting or dropping any of them is not a change of terms. Only a change to this document is a change of terms. An offer with a price attached carries its own price, billing, renewal and cancellation lines at the moment it is offered, and those lines govern that offer.
In one line: "founding user" is a title in a marketing program. It is not ownership, not a role, not a legal standing.
The Founding Users program (the "Program") is a marketing and community program run by Confi Technologies, Inc. ("Confi," "we," "us"), a for-profit corporation.
"Founding user" is a title. It recognizes that you joined before Confi opened to the public. That title, and anything the Program offers, gives you no ownership interest, no shares, no equity, no securities, no profit share, no board seat, no advisory seat, no membership in any governing or advisory body, no employment, no agency, no partnership, and no authority to act or speak for Confi.
The Program is not a board, a council, or a body of any kind. Program votes and polls are not shareholder votes and carry no governance right. Nothing in the Program creates a legal, fiduciary, or financial relationship between you and Confi beyond these terms.
In one line: 18 or older, United States, an email address, and a click that accepts these terms.
Age. You must be 18 or older. The join form does not accept a join unless you confirm this.
Where the Program is offered. Residents of the United States only. The join form asks you to confirm this.
What joining costs. Nothing. Joining is free, is not a purchase, and you are never charged anything for joining or taking part.
How you accept. You join by entering your email address and clicking Join. A sentence directly beneath that button reads: "Joining accepts the Founding Users terms. You need to be 18 or older. United States only, to begin with." These terms are linked from that sentence. Clicking Join is your acceptance of these terms and your confirmation that you have read the Confi Privacy Policy (Section 10).
Open door. There is no selection, application, or approval step. We may refuse or remove a join we reasonably believe is duplicate, automated, or not from a real person.
Record of acceptance. We keep a record of which version of these terms you accepted and when, and whether you ticked the separate marketing checkbox (Section 9).
Nobody is enrolled without clicking. Being on any Confi list does not enrol you. Until you accept, no page and no vote exist for you.
In one line: a list of everything the Program may ever do — none of it promised.
The Program may, at Confi's sole discretion, include: votes and polls (Section 4); perks, badges, name credits, early access, price offers, and contests (Section 5); invitations and referrals (Section 6); a public page for you (Section 7); and published numbers (Section 11).
None of these is promised. Confi may offer, change, limit, suspend, or withdraw any of them at any time, without changing these terms. If Confi never runs a particular activity, or stops running one, that is not a breach of these terms.
The only thing the Program gives you is the title in Section 1.
In one line: we ask, you answer, we read every answer — and then Confi decides. Your vote is advice.
We may invite participants to vote on matters about the Program or about Confi's business, and to answer polls.
Every vote and poll is advisory and non-binding. We read every vote. Confi decides every matter in its sole discretion and may act with a result, against a result, or without regard to any result. A result is not an offer, a promise, or a commitment, and you agree not to rely on any result.
One choice per person. You may change your choice until the stated closing time.
Results are shown as percentages. We do not show counts, and we do not show who voted which way.
After a vote closes, we tell participants what Confi decided.
A vote records your choice and nothing else. We do not analyse your votes to build a profile of you.
We may exclude any vote, poll answer, or join we reasonably believe is duplicate, automated, or not from a real person.
In one line: nothing is promised; if something is ever offered, the offer carries its own terms.
Nothing is promised. The Program gives you the title and nothing else. You receive no payment for taking part. Any perk, badge, credit, discount, free period, early access, price offer, prize, or other benefit is offered only if and when Confi chooses, on the terms stated at that time, and may be changed or withdrawn.
Offers with a price attached. Any offer with a price, a free period, a discount, or a renewal states its own price, billing period, renewal, and cancellation terms at the point of offer, and those stated lines govern that offer. Accepting such an offer is a separate act from joining. You are never charged for anything by joining or taking part. Any Confi subscription is governed by the Confi Terms of Service. An email carrying such an offer is a marketing email under Section 9.
Contests and prize draws. Official rules are shown at the point of entry and govern. No purchase necessary. Void where prohibited.
Early access. May be limited, conditional, or withdrawn; its use is governed by the Confi Terms of Service and Privacy Policy.
Name credits and badges. If Confi ever publishes a list or credit of founding users, only your display name appears, and only if you turned your public page on. Your email address is never published.
In one line: you can share your page; sharing earns you nothing unless we ever say otherwise, right on the page.
You may invite others by sharing your public page link or its QR code. A person who joins through your page is counted as having joined through you. Only you can see that count. We do not show you who joined through you.
We never email your friends. When you share, the message goes from you, from your own phone or account. A person's email address does not reach Confi until that person joins herself.
No referral reward exists. Inviting others earns you nothing under these terms. If Confi ever offers a reward, every page and share carrying the referral will also carry a plain line saying so, and the reward's own stated terms govern it. These terms pre-authorise that disclosure.
You must not send unsolicited bulk messages, misrepresent Confi or the Program, or claim to speak for Confi.
In one line: it is off until you turn it on, it shows only what you chose, and you can turn it off again in one click.
Off by default. Your page at confi.ai/founding/<name> does not exist until you turn it on from your private view. Before then, nothing about you is public.
Nothing is stored before you join. The name field on the sign-up page is a preview only. What you type there is not saved.
What it shows about you — only these, and only the ones you chose: the display name you chose · the words "founding user" · the month and year you joined · one statement you picked from a fixed list Confi provides · the card style you picked from a fixed list.
What it never shows. Your email address. Your votes. Your tally of who joined through you. Any count of participants. Any free text — the Program has no free-text field on public pages, by design.
Your display name. The field starts empty. You choose the name. It must not impersonate a person or a brand and must not be offensive or unlawful. We may change or remove a name that breaks this rule. Without a display name your page cannot be turned on.
Turning it off. At any time from your private view, and it comes down at once. You may also ask us by any route in Section 12; we take it down within 72 hours.
Your story card. Any shareable image you make from your page is yours to post or not. Once you have posted it somewhere yourself, we cannot take it down from that place.
We do not publish how many people are in the Program.
In one line: we email you a link that opens your page as you; it is single-use and expires quickly.
There is no password. We email you a personal link that opens your page as you. Each link is single-use and expires after a short time, and requesting a new link cancels every earlier one.
We record that a link was used to open your page, because that is how your page opens. That is not email tracking (Section 9).
Keep your link private. Anyone holding an unexpired link can act as you on your page. If you think someone else has your link, request a new one or contact us.
In one line: Program notices come with joining; anything commercial needs a separate tick; and we never track opens or clicks.
Program notices are only these: your welcome message and link; links you request; notice that a vote or poll is open; results and what Confi decided; notices about changes to these terms or the end of the Program; and security notices about your link or page. Nothing else is a Program notice. If you no longer want them, you may leave (Section 12). Notices about changes to these terms and about the end of the Program go to every participant.
Marketing emails. Any other email — including any price offer, discount, free period, subscription offer, perk, contest, or early-access offer — is a marketing email. We send them only if you tick a separate, unticked checkbox. Every one carries an unsubscribe link. Withdrawing that consent does not remove you from the Program.
No open tracking. No click tracking. Ever. Our emails contain no tracking pixels and no tracked links. We do not record whether you opened an email or which links you clicked. This is a permanent commitment, not a current setting.
What we do record is an action you take on the Program itself: joining, requesting a link, opening your page with a link, turning your page on or off, choosing your name, statement, or card style, and voting. That is the complete list.
How we reach you. All notices go to the email address you joined with.
In one line: here is every piece of data the Program holds, why we hold it, and how long — and we never sell any of it.
| Data | Why we have it | Our basis | Kept for |
|---|---|---|---|
| Your email address | To run the Program, send your link, and send Program notices | Performing the Program you joined | While you are a participant; deleted within 30 days after you leave |
| Your email address, for marketing emails | To send marketing emails, only if you ticked the box | Your consent, withdrawable at any time | Until you withdraw consent or leave |
| Display name, statement, card style | To show on your public page if you turned it on | Performing the Program; published only because you turned your page on | While you are a participant; deleted within 30 days after you leave |
| Your votes and poll answers | To run votes and compute results | Performing the Program | Individual choices: deleted within 30 days after you leave. Percentage results identify no one and are kept |
| Referral attribution | To show you your own count, measure how the Program spreads, screen out abuse | Performing the Program; our legitimate interest in measurement and abuse prevention | Deleted within 30 days after you leave. A count identifying no one may remain |
| Technical basics — IP address, browser type, request details | Security, and screening out automated or duplicate joins and votes | Our legitimate interest in keeping the Program secure and honest | Deleted within 90 days |
| Your acceptance record | To show what you agreed to and consented to | Our legitimate interest in evidencing the agreement; legal obligation where required | No longer than four years after you leave |
How we use it. Only to run the Program, to communicate with you as described in Section 9, to show results as percentages, and to keep the Program secure. We do not build a profile of you from your votes or your email address. We do not use Program data for advertising.
We never sell it. We do not sell, rent, or share your personal data with third parties for their own purposes. We do not give it to advertisers or data brokers. This is a permanent commitment.
Who handles it for us. Service providers acting on our instructions, in these categories: hosting and edge delivery; an email-sending provider; and a vote and data store. The full list of named providers is in the Confi Privacy Policy.
Where it is handled. In the United States. The Program is offered to United States residents only.
Privacy Policy. The Confi Privacy Policy applies to personal data collected under the Program, including your rights to access, correct, and delete it. Where these terms state a specific period or list, these terms govern for the Program.
In one line: every figure we publish points to its source, and none of them is a promise about you.
Any figure Confi publishes in connection with the Program links to a numbers page that names its third-party sources and carries a dated changelog. Statements about savings are estimates drawn from named third-party surveys. They are not guarantees, and your own results may differ. The Confi app has not yet been released; no figure describes results from the app.
In one line: tell us by any of three routes, and your data goes within 30 days.
Tell us by any one of these routes: email [email protected] from the address you joined with · use the Leave link in your private view, or the leave form at [confi.ai/founding/leave — placeholder] · write to Confi Technologies, Inc., Attn: Privacy, [postal address — placeholder].
If a request does not come from the address you joined with, we may ask you to confirm it from that address, or in another reasonable way. We ask for no more than we need.
We then: take down your public page within 72 hours · delete your email address, display name, statement, card style, individual votes, and referral attribution within 30 days · stop all Program notices and marketing emails.
What remains is what Section 10's "Kept for" column says remains.
Joining does not require you to buy, subscribe to, download, or use the Confi app, and does not create an app account. Joining is free and is not a purchase. Any use of the app is governed by the Confi Terms of Service and Privacy Policy, not by these terms.
In one line: a change that matters needs a fresh click from you; the Program itself can change or stop at any time.
Only this document is the terms. Each version carries a version number and a date.
Changes that matter need a new click. A change that matters is one that reduces your rights, adds to your obligations, changes what data we collect or how long we keep it, or changes Section 16 or Section 17. We email you the changed version and a link to accept it. Until you accept, the version you last accepted governs. If you do not accept within 60 days, Confi may end your participation, and Section 12 applies.
Changes to Section 17 are never backdated, and accepting one opens a new 30-day opt-out window.
Smaller changes — a corrected contact detail, clearer wording with the same meaning, or a new activity Section 3 already covers — take effect on the date stated in a dated notice, no earlier than 14 days after we send it.
Changes to the Program. Confi may add, change, pause, or withdraw any Program activity at any time without changing these terms.
The Program can end. Confi may pause or end it at any time. If it ends, we email every participant, all public pages come down, and that email says what happens to your data.
We may remove you from the Program if you break these terms, misrepresent yourself, or interfere with the Program, its pages, or other participants. Section 12 applies to your data after removal.
THE PROGRAM, ITS PAGES, VOTES, LINKS, AND EMAILS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT PERMITTED BY LAW, CONFI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE PROGRAM WILL BE AVAILABLE, UNINTERRUPTED, OR ERROR-FREE, OR THAT ANY ACTIVITY WILL RUN OR CONTINUE.
TO THE EXTENT PERMITTED BY LAW, CONFI'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE PROGRAM OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO CONFI UNDER THE PROGRAM IN THE 12 MONTHS PRECEDING THE CLAIM, OR US$50, WHICHEVER IS GREATER. TO THE EXTENT PERMITTED BY LAW, CONFI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
What these limits do not cover. Nothing here limits Confi's liability for fraud, gross negligence, or willful misconduct; for death or personal injury caused by its negligence; or for anything that cannot be limited under the law that applies to you, including any non-waivable right under California Civil Code section 1798.150 or your state's equivalent. Where the law does not allow a limitation, it applies only as far as the law allows and the rest of this Section stays in effect.
In one line: individual arbitration, no class actions, and you can opt out of all of it within 30 days.
Governing law. The laws of the State of [governing state — see note], United States, without regard to conflict-of-law principles. The Federal Arbitration Act governs this Section. Nothing limits any right you cannot waive under the consumer-protection law of your state.
Talk first. Before arbitration, either side sends the other written notice of the dispute — to [email protected], or to the email address you joined with — and allows 30 days to resolve it informally.
Binding individual arbitration. Any unresolved dispute is resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in San Francisco, California, or by video or telephone at your election where the rules allow.
Who decides what this section means. The arbitrator, except that a court decides whether the class action waiver and the public-injunctive-relief sentence are enforceable.
No class actions. Arbitration is individual only. You and Confi each waive the right to a jury trial and the right to bring or take part in any class, collective, consolidated, or representative action. This waiver does not waive any right to seek public injunctive relief that your state's law makes non-waivable. If a court decides a claim for public injunctive relief cannot be arbitrated, that claim is decided by a court after the arbitrator resolves all other claims. If this waiver is found unenforceable as to a dispute, this arbitration agreement does not apply to that dispute.
Exceptions. Either party may bring an individual claim in small-claims court, and either may seek injunctive relief in any court of competent jurisdiction.
You can opt out, and it costs you nothing. Email [email protected] within 30 days after you first accept these terms, from the address you joined with. Opting out affects nothing else.
Severability. If any provision is unenforceable, the rest continues, except as Section 17 states for the class action waiver.
Entire agreement. These terms, the Confi Privacy Policy, and the stated terms of any offer or contest you accept, are the entire agreement about the Program.
You cannot transfer your participation.
How to contact us. Program questions and data requests: [email protected], the Leave link in your private view, or the postal address in Section 12. Legal notices: [email protected]. Notices to you go to the email address you joined with.
